Liability Policy

Carefully read this agreement before signing. By signing this agreement you are releasing The Backcountry(DBA Mtn. Mike’s-herein referred to as Mtn. Mike’s Sports) and all equipment manufacturers from all liability, including liability for negligence, and acknowledging that Mtn. Mike’s Sports is disclaiming all warranties.

NOTICE OF RISK: I accept for use the equipment listed on this form and accept fill responsibility for the return of the equipment in the same condition as it was rented to me. In case of theft or loss, I am responsible for the replacement value of the equipment. In case of abuse of excessive damage I will be charged for the repair or replacement of the equipment. I agree to return all rental equipment by the agreed date and time and in clean condition to avoid any additional charges.

ASSUMPTION OF RISK: I understand and am aware that skiing, snowboarding, snowshoeing and fat biking are HAZARDOUS activities. I understand that the sport of skiing, snowboarding, snowshoeing and fat biking and the use of this equipment involve risk of injury to any and all parts of this user’s body and possibly DEATH. I hereby agree to freely and expressly assume and accept any and all risks of injury by use of this equipment while skiing, snowboarding, snowshoeing or fat biking.

LIABILITY AGREEMENT: I understand that telemark, Nordic, snowboard and snowshoe equipment being furnished forms a part of or all of a ski/boot/binding system which will not release at all times or under all circumstances and it is not possible to predict every situation in which it will or will not release and this its use cannot guarantee this user’s safety or freedom from injury while skiing, snowboarding or snowshoeing. If Nordic, telemark, snowboard or any snowshoe equipment is being furnished, I understand that all equipment DOES NOT RELEASE AT ANY TIME. I further agree and understand this this ski/boot/binding system DOES NOT REDUCE THE RISK OF INJURY to any part of this user’s body, including DEATH.

INDEMNITY AGREEMENT: I agree to hold harmless and indemnify Mtn. Mike’s Sports, and its owners, agents and employees as well as the manufacturers and distributors of this equipment for any loss, or damage, including any that results from claims for personal injury, death or property damage related to the use of this equipment. I agree to accept the terms and conditions of this contract. This document constitutes the final and entire agreement between Mtn. Mike’s Sports and the user. Mtn. Mike’s Sports, itself provides NO WARRANTIES expressed or implied and this ski, snowboard, snowshoe or fat bike equipment is accepted “as is”.

I have carefully read this agreement and release of liability and fully understand its contents. I am aware that this is a release of important legal rights and a disclaimer of important warranties and that it is an enforceable contract between myself and Mtn. Mike’s Sports which I sign freely and voluntarily.
